The Filibuster: A Senate Tradition Under Fire

The Senate tradition of unlimited debate allows for the filibuster, a tactic used to prolong debate and delay votes. Before 1917, there was no way to end debate; in that year, a rule requiring a two-thirds majority (cloture) to end a filibuster was adopted. This threshold was lowered to three-fifths (60 votes) in 1975. While traditionally reserved for controversial issues, filibusters have become more common, often halting Senate business. The filibuster has a troubling history, as it has been used to block civil rights legislation. Exceptions exist; a group of 41 senators threatening a filibuster allows the majority leader to avoid a vote. Some advocate for exemptions from the filibuster for voting rights legislation. While criticized by some, filibusters are defended as acceptable in parliamentary systems.
